These Terms of Use ("Terms") are a legal agreement between you and Chalice Health ("Chalice Health," "we," "us," or "our"), the operator of Pocket Med List, governing your access to and use of the Pocket Med List mobile application, website, content, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian who agrees to these Terms. A parent or legal guardian may maintain a dependent's information through the adult's own account.
You may use the Service only if you are legally permitted to do so and are not barred from using it under applicable law.
2. What Pocket Med List does
Pocket Med List helps users organize medication information, create reminders, record medication activity, maintain a medication list, record blood-pressure and blood-glucose readings, review history, create reports, and connect with authorized caregivers or care-team members. Features may differ by device, app version, account type, country, subscription status, or availability.
3. Not medical advice or emergency monitoring
Pocket Med List is an organizational and recordkeeping tool. It is not a physician, pharmacist, medical device, pharmacy, telehealth provider, emergency service, or substitute for professional judgment. The Service does not diagnose, treat, cure, prevent, prescribe for, or monitor any disease or condition.
Do not start, stop, change, delay, or repeat a medication based only on the Service. Follow the label and the instructions of your physician, pharmacist, or other qualified health professional. Safety prompts, medication names, strengths, schedules, refill estimates, interaction or duplicate warnings, health trends, and other content may be incomplete, delayed, or incorrect.
Use a properly calibrated medical device and follow its instructions when measuring blood pressure or blood glucose. Pocket Med List does not verify that a reading was entered correctly or determine whether a reading is safe. Contact a qualified health professional with health questions. Call 911 or your local emergency number for an emergency.
The Service is not continuous monitoring. No person is guaranteed to see a missed dose, unusual reading, alert, care-team update, or request for help.
4. Your information and responsibilities
You are responsible for the accuracy and completeness of information entered into the Service, including medication names, doses, schedules, allergies, refill quantities, blood-pressure readings, blood-glucose readings, and contact information. Review your information regularly and confirm important information directly with the medication label and a qualified health professional.
You are also responsible for:
Protecting your device, sign-in method, and account credentials.
Promptly notifying us if you suspect unauthorized access.
Keeping your contact information current.
Configuring device permissions, time zone, battery settings, notification permissions, and lock-screen privacy appropriately.
Keeping your own backup or printed copy when continued access to a medication list is important.
5. Accounts and sign-in
You may need an account to use some features. You agree to provide accurate information and not impersonate another person. Sign-in may be provided by Apple, Google, or another authentication provider. Your use of those services is also subject to their terms and privacy policies.
Guest or limited-use features may not include cloud backup, synchronization, caregiver sharing, or purchase restoration. If the app offers guest conversion, follow the prompts to connect data to the intended account before deleting the app, changing devices, or signing out.
6. Care teams and caregiver access
Care-team sharing occurs at the account owner's direction. If you invite another person, you represent that you are authorized to provide their contact information and to share the selected records with them. Review the permission level before sending an invitation and remove access when it is no longer appropriate.
If you accept an invitation, you agree to:
Access information only for the purpose authorized by the account owner.
Protect the confidentiality of the information you can view.
Act only within the permission level shown in the app.
Avoid representing that you are a licensed health professional unless you are one.
Avoid relying on the Service for emergency or continuous monitoring.
The app may record care-team activity, including the actor and time. Removing a person's app access cannot retrieve information that person previously exported, copied, photographed, printed, or saved outside Pocket Med List.
7. Reminders, reports, and exports
Reminders and notifications depend on device settings, connectivity, operating-system behavior, time-zone settings, battery optimization, and third-party services. They may be late, duplicated, suppressed, or not delivered. You remain responsible for taking medications according to professional instructions.
Reports and appointment summaries reflect the information in the Service at the time they are created. Review them for accuracy before sharing. If you export, print, email, text, or share information through another app or service, that third party's terms and privacy practices apply to the copy.
8. Free access and Pocket Med List Pro
Pocket Med List may provide core features without charge and offer optional premium features through Pocket Med List Pro. The subscription screen identifies the features included with Pro at the time of purchase. We may add, remove, or change features, but we will not take away prepaid access to the core benefit of a paid subscription period without providing any remedy required by law.
Subscription options
Pocket Med List currently offers the following U.S. subscription options:
Monthly: $2.99 per month.
Annual: $29.99 per year.
The price and currency displayed by Apple App Store or Google Play at checkout control your purchase and may include taxes or regional pricing. No free trial is currently offered. If a trial or promotion is offered in the future, its duration, eligibility, conversion price, and cancellation terms will be displayed before you confirm the purchase.
Billing and automatic renewal
Payment is charged to your Apple App Store or Google Play account when you confirm the purchase. Subscriptions automatically renew for the same billing period unless cancelled before renewal under the applicable store's rules. To avoid the next charge, cancel at least 24 hours before the current period ends or earlier if the store requires.
You can manage or cancel a subscription through your Apple or Google account settings. Uninstalling the app or deleting your Pocket Med List account does not cancel an app-store subscription. Cancelling generally stops future renewal while allowing access through the end of the paid period, subject to store rules and applicable law.
Purchase verification, restoration, and refunds
We use RevenueCat to verify transactions, maintain entitlement status, and support purchase restoration. Restore Purchases attempts to reconnect eligible purchases to the appropriate account but cannot guarantee restoration where the store account, transaction, or account identifier does not match.
Apple or Google handles payment-card information and store refunds. Refund eligibility and processing are governed by the store's rules and applicable law. Contact the store used for the purchase for billing or refund requests, and contact us if you need help identifying the purchase status.
Price changes
We may change subscription prices prospectively. Apple or Google will provide any notice or consent process required for an auto-renewing subscription. A price change does not apply retroactively to a completed billing period.
9. Privacy
Our collection, use, and disclosure of information is described in the Pocket Med List Privacy Policy. By sharing another person's information, you represent that you have authority to do so. Do not use ordinary email to send medical details, passwords, payment-card numbers, or other sensitive information unless our support team specifically provides a secure method.
10. License and permitted use
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Service for lawful, personal, non-commercial medication organization and caregiving purposes on devices you own or control, as permitted by applicable app-store rules.
Except where law allows otherwise, you may not copy, sell, rent, sublicense, distribute, modify, reverse engineer, attempt to extract source code from, bypass security or access controls for, or create derivative works of the Service.
11. Your content
You retain your rights in the information you enter or upload. You give us a limited license to host, process, transmit, display, and create technical copies of that information only as reasonably needed to operate, secure, support, and improve the Service, follow your sharing instructions, and comply with law. This license ends when the information is deleted from our active systems, subject to backup, legal, security, and recordkeeping exceptions described in the Privacy Policy.
12. Prohibited conduct
You may not:
Use the Service unlawfully or to harm, threaten, harass, exploit, or impersonate anyone.
Access another person's records without authorization or exceed care-team permissions.
Upload malicious code, interfere with the Service, probe vulnerabilities, or bypass authentication or subscription controls.
Use automated means to scrape, extract, or overload the Service except through an interface we expressly authorize.
Use the Service to provide emergency response, continuous patient monitoring, prescribing, or medical treatment without a separate written agreement that expressly authorizes that use.
Sell, broker, advertise against, or otherwise misuse information obtained through a care-team relationship.
13. Third-party services and content
The Service may rely on or link to Apple, Google, Firebase, RevenueCat, RxNorm, device notification services, and other third parties. Third-party services are governed by their own terms and privacy policies. Medication terminology or other third-party content may be incomplete, outdated, unavailable, or subject to separate rights. A link or integration does not mean we endorse every third-party product or statement.
14. Changes, availability, and updates
We may update, change, suspend, or discontinue part of the Service for maintenance, security, legal compliance, technical limitations, or product development. We do not promise that the Service will always be available, error-free, or compatible with every device. Install updates promptly; older versions may stop working or may not include current security, privacy, health-recording, or subscription features.
15. Suspension and termination
You may stop using the Service at any time. You may request account deletion as described at pocketmedlist.com/delete-account. Account deletion is separate from app-store subscription cancellation.
We may suspend or terminate access if we reasonably believe you violated these Terms, created a safety or security risk, used the Service unlawfully, or if suspension is necessary to protect users or the Service. Where appropriate, we will provide notice and an opportunity to contact us.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, dispute terms, and payment obligations already incurred.
16. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Chalice Health and its affiliates, officers, directors, employees, volunteers, licensors, and service providers disclaim express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and that the Service will prevent missed doses, medication errors, adverse events, or medical emergencies.
Some jurisdictions do not allow certain warranty disclaimers, so some of this section may not apply to you. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
17. Limitation of liability
To the maximum extent permitted by law, Chalice Health and its affiliates, officers, directors, employees, volunteers, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, goodwill, or opportunity; or damages arising from missed or incorrect reminders, inaccurate entries, device or network failure, third-party conduct, unauthorized caregiver use, or reliance on the Service for medical decisions.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid for Pocket Med List during the 12 months before the event giving rise to the claim or (b) US $100.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited, including liability for fraud, willful misconduct, or other liability that applicable law requires us to bear.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Chalice Health and its affiliates, officers, directors, employees, and volunteers from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your material violation of these Terms, or your unauthorized access to or disclosure of another person's information. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.
19. Governing law and disputes
Before filing a formal claim, you and Chalice Health agree to try in good faith for 30 days to resolve the dispute informally. Send a written description of the dispute to info@pocketmedlist.com. This requirement does not prevent either party from seeking urgent injunctive relief or using an available small-claims process.
Except where the law where you live requires otherwise, these Terms are governed by Texas law, without regard to conflict-of-law principles, and disputes will be brought in the state or federal courts with jurisdiction in or over Ellis County, Texas. These Terms do not limit consumer rights that cannot be waived by contract.
20. Additional terms for Apple users
If you obtained the app through Apple App Store:
These Terms are between you and Chalice Health, not Apple. Chalice Health, not Apple, is responsible for the app and its content.
Your license is limited to a non-transferable license to use the app on Apple-branded products you own or control as permitted by the Apple Media Services Terms and applicable Usage Rules, including any permitted Family Sharing or volume-purchase use.
Chalice Health is responsible for maintenance and support; Apple has no obligation to provide maintenance or support.
To the extent an applicable warranty cannot be disclaimed and the app fails to conform to it, you may notify Apple for a refund of the purchase price paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation, and Chalice Health is responsible for other claims attributable to a failure to conform to an applicable warranty.
Chalice Health, not Apple, is responsible for addressing claims relating to the app, including product-liability, legal or regulatory, consumer-protection, and privacy claims.
Chalice Health, not Apple, is responsible for investigating, defending, settling, and discharging a third-party intellectual-property claim relating to the app.
You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as supporting terrorism, and you are not on a U.S. government prohibited or restricted-party list.
You must comply with applicable third-party agreement terms when using the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
21. Additional terms for Google Play users
If you obtained the app through Google Play, your use is also subject to the Google Play Terms of Service. Google processes the purchase and manages cancellation and refund requests under its rules. Chalice Health, not Google, is responsible for the app, its content, maintenance, and support, except as applicable law or Google's terms provide otherwise.
22. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and Chalice Health about the Service, unless a separate written agreement expressly applies. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of an organizational change, subject to applicable law. Headings are for convenience only.
23. Changes to these Terms
We may update these Terms as the Service changes. We will update the effective date and provide additional notice when required by law or when a change is material. Changes apply prospectively. If you do not agree to revised Terms, stop using the Service and cancel any subscription before its next renewal.
